These Terms of Service (hereinafter referred to as “Terms”) are a legally binding agreement between VyPrompt (hereinafter referred to as “we”, “us”, “our”) and all users who access and use the vyprompt.com website and services (hereinafter referred to as “you” or “user”). By browsing, registering, and using all functions of the VyPrompt platform, you confirm that you have read, understood, and fully agreed to abide by all clauses of these Terms. VyPrompt is an online sharing platform for AI prompt templates. We provide users with free browsing, querying, collecting, and sharing of AI prompt resources applicable to mainstream generative AI tools such as ChatGPT, Midjourney, DALL-E, Claude, and Stable Diffusion. We reserve the right to adjust, upgrade, suspend or terminate partial or all platform functions according to business development and operation needs without prior notice to users.

2. User Eligibility

You confirm that you are at least 18 years old or have the supervision and consent of legal guardians to use this platform. You agree to use our services only for legal, legitimate, and non-commercial or authorized commercial purposes. You shall not use the platform for any illegal, harmful, infringing, or prohibited behaviors.

3. User Conduct and Obligations

When using VyPrompt services, you shall independently bear all responsibilities for your own behavior and content release. You agree not to:
  • Violate national laws, regulations, and public order and good customs
  • Publish, spread, or share illegal, violent, pornographic, discriminatory, threatening, and infringing content
  • Use the platform to carry out fraud, advertising harassment, malicious attack, data crawling, and server intrusion behaviors
  • Modify, copy, distribute, resell, or commercially exploit platform resources in an unauthorized manner
  • Maliciously register accounts, brush traffic, or interfere with the normal operation of the platform
  • Upload or share virus programs, malicious scripts, and other harmful files

4. Intellectual Property Rights

4.1 Platform Intellectual Property
All texts, pictures, logos, interface designs, data sorting, and functional codes on the VyPrompt platform are protected by intellectual property laws. Without our written authorization, no user or third party may copy, reproduce, modify, disseminate, or use them for commercial purposes.
4.2 User Submitted Content
Users independently own the intellectual property rights of the original prompts submitted and published on the platform. By publishing content on VyPrompt, you automatically grant us a global, non-exclusive, royalty-free license to display, disseminate, and store the content on the platform for the purpose of providing services. You guarantee that the content you publish does not infringe the legitimate rights and interests of any third party. If any infringement dispute occurs, you shall independently bear all legal responsibilities.

5. Disclaimer of Warranties

VyPrompt provides all services on an “as is” and “as available” basis. We do not make any express or implied warranties for the completeness, accuracy, timeliness, and applicability of the platform prompt resources and services. The AI prompt templates provided by the platform are only for user reference and learning. We are not responsible for any direct or indirect losses caused by users’ use of prompt templates for creation, business, and other behaviors.
We do not guarantee that the platform will operate uninterruptedly, without errors, or that the server will be completely safe. We will not be liable for service interruption, system failure, data deviation, and other problems caused by network failures, third-party service abnormalities, force majeure, and other uncontrollable factors.

6. Limitation of Liability

To the maximum extent permitted by applicable laws, VyPrompt and its operation team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to economic loss, data loss, profit loss, and reputation loss arising from your use or inability to use our services.

7. Account Management and Termination

We have the right to suspend or terminate your platform use authority and account service in the following situations: violation of platform terms, illegal use, malicious damage to platform interests, or receipt of effective infringement complaints and legal notices. After the account is terminated, your right to use the platform services will cease immediately, and we have the right to delete your relevant data in accordance with rules and laws.

8. Third-Party Services

The platform may involve third-party AI tools, website links, and cooperative services. We do not control third-party services and are not responsible for the quality, safety, and legality of third-party services. Your use of third-party services shall abide by the terms of service and privacy policies of the corresponding third parties, and all risks shall be borne by yourself.

9. Revision of Terms

We reserve the right to revise and update these Terms of Service according to business adjustments and legal requirements. The revised terms will be published on the website and take effect on the date of publication. Your continued use of the platform after the update of the terms means that you accept the revised terms.
